Providing Accurate Information

Conduct an Investigation Before Filing

Filing a DMCA takedown request is a serious legal matter with real consequences. Before submitting a takedown notice:

Thoroughly Investigate: Ensure that the content in question is truly infringing on your copyright and not used under “fair use” or other permissible grounds.Consider Contacting the User Directly: In many cases, contacting the user or content creator to address the issue directly can resolve disputes without escalating to formal action.

No Automated or Bulk Notices

You must evaluate the facts for each takedown request on an individual basis. Automated or bulk-submitted DMCA notices are often invalid and may result in unnecessary removal of legitimate content. Bluewater Medical requires properly reviewed and fact-checked notices.

Counter Notices

If a takedown request is filed against your content, you may respond with a counter notice if you believe the takedown was a mistake. If a valid counter notice is submitted, we will restore the content within 14 business days unless the original copyright holder informs us that legal action has been initiated.

How We Handle DMCA Notices

Bluewater Medical does not evaluate the merits of copyright claims but determines if DMCA notices meet the minimum statutory requirements. The parties involved must evaluate the validity of their claims with their legal counsel.
